CLAIM FOR DAMAGES
ACTION BY INSURANCE COMPANY (P.A.) WELLINGTON, May 19. The Dominion Life Assurance Office proceeded against the Australian Mutual Provident Society before Mr Justice Ostler claiming a total of £l7OO for damages resulting from a statement reflecting on its financial position allegedly made by an A.M.P. agent and his sub-agent to three Taranaki farmers. The defence denied the alleged publication, denied that, if made, the statements were defamatory, and stated that expressions of regret and unqualified assurances that any reflections would be without foundation had been written to the farmers concerned and published in two Taranaki newspapers, and that a cheque for £52/10/-, representing the plaintiff’s legal costs, had been sent to the plaintiff’s solicitors and had been returned. The defendant had also terminated the agent’s appointment. The plaintiff had therefore suffered no damages.
