MAGISTRATE’S COURT

THURSDAY (Before Mr R. C. Abernethy, S.M.) Angus William M. Mclntosh, a labourer, aged 21, (Mr H. E. Russell), appeared on a charge of the theft at Makarewa on June 18 of 34 petrol coupons valued at 8/6, the property of Noel Paddon. , , , Detective J. W. Hill said that the accused and the complainant spent a night at the accused’s hut at Makarewa. When the complainant left the next morning he left behind some clothes in which there was a wallet containing petrol coupons. He later returned for the clothes and afterwards discovered the loss of his coupons. When questioned by the detective the accused had admitted taking them. In answer to a question by the Magistrate, Detective Hill said that 8/6 was the payment which had to be made to have the coupons replaced. In asking for leniency for his client Mr Russell said the accused was a State child and had not had the best of chances in life. There was some money in die wallet but he had not taken any of this. In certain circumstances the theft of petrol coupons would be visited by a heavy fine, said the Magistrate, but in this case he would extend leniency. Judgment for the plaintiff for £l5, costs £4/3/-, was given in a case in which Gormack, Wilkes and Davidson Limited (Mr J. C. Prain) proceeded against George Goodsir, of Kennington (Mr B. W. Hewat) for £22. The claim was for the cost of repairs to the defendant’s motor-car.

Evidence was given that the defendant had sent his car in to the garage for greasing and oiling. It was afterwards found that there was a crack in the gearbox of the car. The defendant alleged that this should have been discovered by the plaintiff’s staff, whereas the plaintiff alleged that there was no crack in the gear-box when the car was examined.
