HUSBAND IN MENTAL HOSPITAL
WOMAN’S PETITION FOR DIVORCE (United Press Association) WELLINGTON, October 11. A petition for divorce by a woman whose husband has been in the Porirua Mental Hospital for 10 years, but who has not been subject to a reception order till this year was brought before Mr Justice Blair.
The action is in the nature of a challenge of the decision of Mr Justice Callan in 1936 that in circumstances where a patient is a voluntary boarder it could not be said that he was "confined close” in a mental institution as required under the Divorce and Matrimonial Causes Act. Mr Justice Blair consulted other judges and the case will be heard by a Bench of at least three judges in November.
