JUDGMENT GIVEN ON APPEAL

RIDING OF AIRAM IN HURDLE RACE RACING CONFERENCE MODIFIES PENALTY (United Press Association) WELLINGTON, May 26. Judgment has been given by the New Zealand Racing Conference on the appeal by J. P. McLaughlin, jockey, against the decision of the Auckland District committee “that the mare Airam was not run on its merits in the Northland Hack Hurdle race at Whangarei on April 21, 1939, and that the appeal lodged by the chief stipendiary steward against the decision of the stewards of the Whangarei Racing Club be upheld, that the rider of Airam (J. P. McLauchlin) was guilty of a breach of rule 282 of the Rules of Racing, and that McLaughlin be and is hereby disqualified for six months from May 2, 1939.” The judgment states: “Upon hearing the evidence and the representative of the Auckland District committee and of the Whangarei Judicial Committee, and upon hearing counsel for the jockey, J. P. McLaughlin, we are of opinion that the evidence falls short of showing any dishonest riding of the horse Airam within the meaning of rule- 282 of the Rules of Racing, but we are also of opinion that by reason of the incompetent and badly judged riding of the jockey Airam was not run on its merits, nor properly ridden out. We therefore allow the appeal and we remove the penalty of six months’ disqualification imposed by the Auckland District committee, and substitute two months’ suspension as from May 2, 1939. , We also consider on facts that the action taken by Mr C. Gomer, stipendiary steward, was fully justified.”
