FALL FROM TRAMCAR

DAMAGES AWARDED. (Per United Press Association.) Auckland, November 7. A passenger who fell from a tramcar bound to Avondale in May last made a claim in the Supreme Court against the Auckland Transport Board for damages for the injuries he received as a result of his fall. Plaintiff, Harold Thomas Middleton, a market gardener of Avondale, claimed the accident was due to negligent driving of the tramcar as a result of which he was thrown off his balance as he stood on the platform. Plaintiff had suffered a serious compound fracture of the skull and he would be permanently unfitted for his work. General damages of £l5OO and special damages of £lB4 were claimed. The board denied there had been any negligence on its part and alleged that while under the influence of liquor plaintiff either fell from the platform or attempted to leave while the tramcar was in motion.

The jury brought in a verdict by a majority of nine to three that there had been negligence on the part of defendant board and awarded £5OO general and £lB4 special damages.
