CHARGE OF ARSON
EVICTING A TENANT. An elderly man named William Smith appeared in the Police Court yesterday afternoon before Mr James Ward, J.P., charged with committing arson at Nightcaps in that he did burn a dwelling house, the property of himself. Smith was also charged with committing mischief by destroying clothing to the value of about £B. The Senior-Sergeant said that the accused owned property at Nightcaps and a man named Findlayson lived with him. The accused had been drinking and had ordered Findlayson to leave the house. When Findlayson refused to leave accused set fire to the house and burned it down. There was a mortgage on the property of £l3OO, but it was not known whether this was partly on the house or wholly on the land. The minor charge arose through Findlayson losing two suits and some other articles of clothing in the fire. Accused was remanded to appear before the Magistrate on October 31, bail being allowed for £lOO in his own recognizance and £lOO other security.
