CLAUSE 42. Per United Press Association. WAIHI, Febi 23. Thomas Gardner, a music dealer, was fined 5s and costs for being on licensed premises during prohibited hours. The facts are that Gardner's wife being seriously ill, he went to the Rob Hoy hotel at 11 p.m. to obtain a stimulant for her. Finding Sergeant Sheehan on watch, he aiipealed to him for permission to get some gin. Gardner, whom the police admit, is a sober man, asked the Sergeant to go into his house, next door, with him and satisfy himself as Vo his wife’s illness, but he refused to do so. On returning home, Gardner finding his iwife no better, in desperation, went again to the hotel, and procured some gin. Tlio case caused great public indignation, and the fine and legal costs were promptly paid by public subscription as a protest against the action of the police, the amount being offered twenty-fold.
