MAGISTERIAL

TEMUKA—MONDAY, JAN. 28th, 1901,

(Before Messrs E. Cutten and J. T. Hardy, J.Ps.)

The police applied for the issue of a prohibition order against a local tradesman. The application was opposed by Mr T. Cheyne Farnie on the grounds that his client had firmly resolved to discontinue his habits, and further that the issue of the order would materially interfere with his business, as it would debar him from attending several of his customers, who are hotel-keepers, and would prevent him visiting sample rooms attached to hotels. He asked that an adjournment for a month be granted to test his client’s resolution.

The Bench thought it would be in the best interests of the tradesman indicated, and of his family if the application by counsel was refused, and an order was made to apply to the Timaru and Geraldine districts.

11. Roberts was charged on remand with stealing a dog, the property of James Blyth, junr.

Accused, who was defended by Mr T. C. Farnie, elected to be dealt with summarily, and pleaded “not guilty.” Evidence was given by Jas. Blyth, jun., T. Oliver and John Cooper. Accused had been seen to tie a string round the dog’s neck and lead it away. It was recovered by the owner, who followed him on a, bicycle, and took Ilia dog away after giving the accused “ a few clouts.” The defence was that accused was in

an intoxicated condition and took the dog with no criminal intent, but believing it was one which belonged to his employers. The Bench convicted accused, and ordered him to pay £2 and costs.
