Justice Cooper’s ;; judgment in the Pawson bankruptcy ia available. Erl win Pawson was a sawmiller o£ Dannevirke and Obakune. There has been much litigation in connection with this bankruptcy, and some interesting developments in these particular oases. Mrs Mnnco sought to have her name substituted in a proof of debt for Grant and Kiley, Ohakcma blacksmiths, who were owed £6l 13s. Prior to his bankruptcy, Pawson transferred his. properties to B. G. and J. lagley and later this transaction was voided as fraudulent, the property providing more than sufficient to pay the creditors in full. While this action was pending, Mrs Monro employed Joseph lagley to secure the transfer of the creditors’ debts to her, so that he could exercise their votes to prevent the action against Ingleys going. to trial, Pttwsoa’a transfer of these properties to the lagleya being partly a schema to prevent his properties being realised. Ingley told Grant that ha was acting for Mrs Muaro, and offered him 7a 6J in the £l, tailing him that 13 6d would be paid later on. Mrs Mucro, howtvar, had not supplied luglay with funds, and he gave Grant ami •Duncan Johnston a promissory note for 7s 6d ia the £l, which was dishonoured. Grant and Riley and Johnson had received nothing bat worthless paper. HisHonor held tba fact of their proofs ,of debt must stand, and Mrs Macro’s application be dismissed with costs.*

XPitzheEbart, solicitor, who had astaaiij' received 7s 6d in the £1 from Mrs Monro, and* given her a receipt in fail for his claim on Pawsoa’a estate,gnow asked that his claim in the estate be reinstated on the ground of fraudulent repreeentatlon by Mrs Munro. His Honor found it impossible to decide on the affidavits of Mr Pltzherbert and Mrs Munro, and directed that the case be beard by a jury of five.
