CLAIM OVER HOUSE
SETTLEMENT REACHED ADVICE FROM THE BENCH An announcement that a settlement satisfactory to both parties had been reached w'asi made in the Supreme Court this morning, when the case of Young versus Hopps, which was part-heard yesterday, was called.
The case was one in which John Wesley Young (Mr. J. S. Wauchop) proceeded against George Albert Hopps (Mr. A. A. Whitehead) for specific performance of a contract to purchase a house, (he defendant having repudiated the bargain on the grounds that the house was unsound. In adjourning the case yesterday, after hearing evidence, the Chief Justice, Sir Michael Myers, indicated to counsel that even if the claim of plaintiff was allowed, the only effect would bo to ruin the defendant without any benefit to the plaintiff.
When the case was called this morning Mr. Wauchop informed His Honour that a satisfactory settlement had been reached, and that the case would not be proceeded with any further.
His Honour expressed his pleasure with the outcome of overnight consideration bv the parties to the action.
