FIRE BOARD LOAN
SUPREME COURT ACTION HEARING POSTPONED A point of some constitutional interest .vas discussed in banco this morning before Mr. Justice \U'i'(\ in Hie action of 11. V. Lunken v. the Gisborne Five Hoard and others. The plaintiff had obtained an order for discovery of documents and the secretary to the Local Government Loans Board has in his answering affidavit attached a certificate of the Minister of Finance, the Hon. W. Nash, directing Mm not. to produce the documents, 'the daintiff, then took out a summons lor inspection claiming to see the documents, which consist mainly of reports and memoranda from the Public Works Department to the Loans Board. The documents had been obtained for the purpose of considering the Fire, Board's application lor a loan, and the plaint ill' contended that he was- entitled to see what difference. In Hie reports led lo the original refusal by Ibe Loans Board to approve if the loan bong changed to consent. A considerable number of authorities wen- cited. His Honour reserved judgment, stating that tbei point was of considerable public importance, and thai the hearing of the action would require to stand over until bis decision on this particular point was available. Mr. L. T. I'.iirnard. with him -Mr. O. W. lies, appeared lor the plaintilf in support of the application for inspection, and Mr. F. VV. Nolan, instructed by the Crown Law Office, opposed it.
