The importance of depositions made Jin flic. Magistrate’s Court was made Iduring a case heard in the Auckland •Supremo Court before Mr. Justice Fair. {Counsel objected to certain statements !hy a witness, saying they had not, appeared in the lower court, depositions land that lit) had not lmd a ’ sufficient opportunity of answering them. His Honor commented that it should be recognised that depositions did not necessarily represent all a witness could say, but were usually sufficient to say whether a magistrate should send a case on for trial. However, it was realised that counsel should have a fair opportunity of considering any new points raised.
