CLAIM FAILS
DISMISSAL OF EMPLOYEE AMPLE JUSTIFICATION (Per Press Association.) WELLINGTON, this day. In a reserved judgment, the magistrate, Air. E. Page, found in favor of Scott Gandy, Limited, defendants in an action in which Lawrence *S. Gandy, a salesman employed by tho firm from March, 1930, until February, 1932, claimed £lls 13s 2d for arrears of salary and expenses, and £2OB damages for wrongful, dismissal. In a cross-action in connection with a car which Gandy failed to give back to Hie firm until a writ to recover it had been served, Mr. Page awarded Dio firm £ls damages anil costs amounting to £4O 3s 2d against Lawrence Gandy.
After reviewing the whole of the circumstances in connection with the case, Mr. Page said the plaintiff’s conduct showed that he was unfit to hold his position, and there was ample justification, in the magistrate’s view, for his dismissal without notice.
