CHEAPER LITIGATION
AN ENGLISH SUGGESTION NEW RULES DRAWN UP (Elec. Tel. Copyright—United Press Assn.) LONDON, May 1. In consequence of “representations by the Chamber of Commerce and other business men, Lord Sankey, Lord High Chancellor, has drawn up new rules designed to reduce the cost of litigation and simplify the hearing of law cases.
Certain classes of cases have been definitely excluded from tho new procedure, including libel, breach of promise, and cases where a plaintiff alleges fraud, but tho solicitor for the plaintiff in future will be entitled to ask that other classes of cases be tried according to the simplified procedure. The judge will then bo able to transfer the case to the assizes or county court, dispense with a jury, limit the number of witnesses, curtail the number of documents placed before the court, and eliminate all things now tending greatly to increase costs. The judge will also be able to record the consent of both parties waiving the right of appeal. A memorandum points out that the new procedure offers great possibilities to suitors desirous of a.speedy conclusion to a case, but adds that no system can help those who arc hostile to settlement at a reasonable expenditure of time and money.
