A case of considerable interest to persons subject to increased land tax and income tax in respect of income from farm lands levied under the Land and Income Tux Amendment Act of lH2b was opened to-day before t lie Null Court, Their Honors the Chief Justice, Sir Micnuel Myers, Air. Justice Reed, and Mr. Justice Liair. Mr. 11. F. Johnston, K.C., with him Mr. L. K. Wilson, appeared for the appellant taxpayer, whose name was not divulged, while Mr. P. B. Cooke appeared for the respondent, the Commissioner of Taxes. .. Mr. Johnstone stated at was admitted in the case that appellant hud at all material times derived income from farm lands exceeding 2 1 4,000 m value, that being the sum at which the income tax began at all on farm land. Subsequent to tho passing of the Land and income Tax Ainemlinefit Act of 102!), the Commissioner of Taxes assessed appellant for the year commencing April 1, 1929, upon income derived from ail sources, including farm lands during the year ending March 31, 1929. Appellant objected to the asscssmoui on lwo principal grounds, the first being that the ameuding Act of .1929 did not operate until the assessment year commencing April 1, lO.ltl, and that, therefore, in the assessment year just past the appellant should not. have been assessed in rcspect of income tax from farm lands. The second objection was that if the first objection was unsound, and appellant was liable to be taxed on income derived from farm lauds in the year commencing April 1, 1929, then the method of assessment was incorrect.
