CLAIM FOR BOARD

JUDGMENT AGAINST YOUTH A claim for £ll ss, allegedly due for board and lodging, occupied the attention of Mr E. C. Lewey, S.M., in the Magistrates' Cburt_this morning. Mi" S. V. Beaufoy appeared for the plaintiff, Frederick James, and Mr D. W. lies for the defendant, William Hope. Mr. Beaufoy explained that a contract was entered into between the plaintiff and the defendant for the latter to buy the plaintiff's milk run at £75. The plaintiff was to graze the horses in return for certain work he required the other to do, and defandant was to pay 25s a week board, but this he had failed to do.

The plaintiff stated that the defendant was still owing £ll 5s for board. Witnes sold him the milk. Previously there was a prosecution because the milk contained water, and witness took the blame'to save the lad. The run •was to belong to witness until the defendant had finished paying it off. Witness agreed to graze his horses in return for work he was to do, and to give him board at 25s a. week.

Mr lies said as the contract for board was part of a larger contract, infancy was a ground for defence. Moreover the defendant would state that there was an express agreement to do the work for the board. The defendant was not asked for board at the end of the first month.

The defendant, William Hope, aged 16, stated that he purchased the run from the plaintiff for £75, to be payable at the rate of £lO monthly. To Mr Beaufoy witness admitted that he owed about £39 to James for milk. The magistrate gave judgment for the plaintiff iat £5, giving credit for the £6 the plaintiff had collected of the debts owing to the defendant.
