ALLEGED ASSAULT.
A PRIVATE INFORMATION
AGGRESSOR ROUND OVER
At the Magistrate’s Court this morning, before Mr. K, C. Levvev, S.M., Peter McKeand (Mr. J. S. Wauchop) proceeded against Thomas W. Martin (Mr. A, T. Coleman) for an alleged assault, and for a surety to keep the peace. Mr. Wauchop stated that on three occasions during the last six months the defendant luid l threatened the plaintiff, the threats culminating in a direct assault, when the defendant caught the plaintiff in Wainui road, seized him by the neck, and threw him to the ground. Mr. Coleman said a technical assault was admitted. The defendant was of the view that remarks made by the plaintiff were objectionable, and be had taken steps to stop it. They were consenting to sureties to keep the peace, and as the assault was not a. grievous one, he submitted that the penalty should be a very light one.
Magistrate said he was not disposed to treat assaults too leniently. However, as counsel had practically agreed upon the matteri, lie would not be severe. A fine of £2 and costs £3 14s would be imposed, and the defendant would be required to find a surety of £25 to keep the peace for twelve months.
