MAGISTRATE'S COURT.

.mJudgment by default was given by Mr Jl S. Barton, S.M., at the Magistrates Court this morning in the following cases : — Williams and Kettle Ltd. (Mr Nolan) ' v. George Paul Cobbettt, £06 2s Bd, and costs £5 14s 6d; E. Chrisp 'and Son (Mr H. Chrisp) v. Joseph Edwards, £4 10s 6d, and costs £1 6s v 6d ; D. J. Larnach '(Mr Nolan) v. Chas. Frederick Harper (costs only), £2 3s ; E. Chrisp and Son (Mr H. Chrisp) v. Colin Tuhi, £30 7s 4d, costs £3 lis; 0. H. Cooper (Mr Wauchop) v. Julius Dunlop Donner, £52 9s Id, costs £3 16s. Orders were issued in the judgment summons cases of Frederick Davis v. Frank McEwen, £4 15s, in default five days' imprisonment; and Daulton Bros. (Mr Nolan) v. Paratene te Hau, £24 6s 9d, in default 25 days' imprisonment. Lillian Catherine White (Mr Willock) proceeded against' Joseph CConnell (Mr Nolan) on a judgment summons case. The defendant stated that he had earned between £3 and £3 10s since the date of the judgment. His rent was £1 per week, and he had a wife and three, children to provide for. — Examined by Mr Willock, defendant said he was a master mariner, but he was unable to find a vacancy in Gisborne. He derived his £3 per week from working on the wharf. He got a fair share of the work, but there were about 200 men for the work to be divided amongst. — His Worship considered that no proof of means had been brought by the judgment creditor, and the order was refused. In the defended case of Frederick Thomas Lancaster (Mr Willock) v. Frederick Small Bowen (Mr Wauchop), the claim concerned wages alleged to be due for work performed, and a small sum for hotel expenses. The full claim was for £12 17s 6d.
