Forrest, an ex-member ot'l Parliament, died a year a»Oj leaving an estate valued at £103,137'rwhereoi'' over £80,000 was bequeathed to create a trust for charitable and philanthropic pur poses. Mr Charles L. Forest, a nephew, as the only next of kin, sought the Court's j ruling as to whether the trust was void, on the ground of uncertainty.

Tho Chief Justice, m delivering the Court's judgment, declared that Mr Forrest died intestate, and the whole trust is void for uncertainty. The whole of the money therefore goes to th<? nephew, upon clearly establishing that he is the sole next of kin.
