TE KARAKA COURT.
The monthly sitting of the Magis trate's Court was held at Te Karaka today, before Mr W. A. Barton, S.M. ' FAILURE TO ATTEND CAMP. '
Bernard C. Hofferman pleaded guilty to a charge of failing to attend the Oringi camp. Defendant said he only had half a day's notice of the camp, and he could not get away m that time. Sergt. -Major Henry produced a copy of the letter sent to defendant, which showed that that was so. Defendant had just been, transferred from Wanganui. — His Worship said the notice did seam short, and he imposed a fine of 5s without costs.
A similar case against Sydney Heffei'nan was adjourned owing to the illness of defendant.
Malcolm J. Orr, for whom Mr Burnard appeared, pleaded not guilty to a similar . charge. — Sergt..Major C. R. Henry gave evidence as to the usual notice of the camp having been sent to defendant, who did not attend. — To Mr Burnard : Defendant had hot taken the oath. He resided at Kanakanaia.— To Senior-Sergt. Hutton : Defendant did not turn up to any parade, as he resided outside the training area. He was exempt from drill, but not from camp. — To Mr Burnard : Witness could not say whether defendant had been posted by, mistake. It was the rule not to post men m outlying districts. — Mr Burnard submitted that" the information must dismissed on the evidence. — In dismissing the information, His Worship said that even if defendant had been sworn m, m all due respect to the military authorities, he should think it useless sending such men to camp who were exempt frohi drill, as they would only be an obstruction to the others. ;
' ALLEGED TRESPASS. | Sydney Piniha pleaded not guilty to a charge of wilfully trespassing on the premis.es of Rlrs , .Delaney on June 6th. Mr Hei appeared for accused. Evidence was given that accused went to Mrs Delaney's house about 9 p.m., and commenced wrangling about getting credit. He , stood inside . of the door, holding his horse by the bridle. He was under the influence of liquor, and when ordered out of the shop he refused to go until Constable Doyle arrived and put him out. Defendant had given trouble under similar circumstances on previous occasions.— Mr Hei said Mrs Delaney was a storekeeper, arid every member of the 'public had a right to enter her store, ahd if they asked civilly for goods it could not. be said to be a trespass.— His Worship : Undoubtedly ; so long as they behave themselves and leave when requested to do so. — Accused gave evidence that he asked for some apples m a civil manner, but he did not get any reply, and he was waiting; that was why he stayed so long. — His Worship said there was no doubt accused had made himself a nuisance. He would be fined , 10s and costs £1 2s 6d, m default 48 hours' imprisonment. CIVIL MATTERS.
Judgment was given for plaintiff m the following undefended civil cases : — i Emma Evinson (Mr Burnard) v. Tua Pawa, £13 10s and costs £1 15s 6d; same v. Tawa Porter, £4 2s 9d and costs 17s; Waikohu County Council (Air Burnard) v. Karaitiana Ruru, £56 3s 5d and costs £4 8s; same v. Jane Carter, £1 ls costs ; J. W. Brown (Mr Burnard) v. Michael Dwyer, order by consent for payment of 5s ncr week until the debt (£25 3s 6d) is paid off; C. A. Foote (Mr Hei) v. T. P. Sydney, order by , consent .for , payment of £22 14s 3d within six months,- in default 23 days' imprisonment; H. S. ( Northe (Mr Burnard) v. Sonny Ruru, order for immediate payment, £2 5s 6d, m default two days' imprisqnment ; ?utei*e Wi Repa (Mr HeiJT v_ , Jlenari Okeroa, order by consent for "payment of £8 10s m six months,- in -default eight days' imprisonment.
