Another phase of the well-knoAvn Mewhinney ease avos before the Magistrate's Court to-day, when Oliver Mewhinney and Jeremiah Stevenson were charged with breaking, entering, and theft at the dwelling of Nettie Mewhinney, at Seatoun, where complainant had been living since the divorce proceedings about May, 1909. It was alleged that defendants broke into the house, and took a number of household articles. Mr Wilford, appearing for the defence, said that he Avould prove Mrs MeWhinney.'s story Avas not correct. A somewhat unusual application came before Mr Justice Williams, due to a curious mistake m the will of Bridget Elizabeth Mcßeddie, widow. The will contained a ' clause bequeathing all her household effects and goods pleasing to Aromen to her grand -da\igbter^ named Mary BroAvn, of Mataura. The evidence showed that there ere three granddaughters named Brown at Mataura, but not one Mary BroAvn, and not one was knoAvn as "Mary." It was stated also that the next-of-kin, Richard. How-; ard, was Avandering about m Australia. An order Avas made that the legacy lapsed to Mary Brown through uncertainty, and that inquiries be made for the next-of-kin.
