FARMERS' DISPUTE.

♦ The adjourned application for the Magistrate's adjudication in a dispute between James Edwin Benson (Mr' Stock) of Ofmond, and Robert Campbell Miller (Mr F. W. Nolan), of Waerenga-a-hika, regarding the repairing of a dividing fence, and as to the line of same, was called on again at the Court to-day. William Graham, of Ormond, gave evidence that he had recently made an inspection of the fence in question. The whole of it wanted repairing badly, ex-* cepting about 15 chains which complainant had repaired. There was a portion where it would be impossible ever to have a good fence, and consequently the line should be shifted on to a ridge on defendant's side, which would give complainant six or seven acres of defendant's land. A reasonable rental for Benson to pay Miller for the land so taken would be 6s an acre per year. — By Mr Nolan : The present line of fence was liable to slip away. Stock could get through the defective portions of the | fence. He did not know how long the fence had been erected. If a new - fence was erected on the present line it would hold until rain came ; then it would probably slip away. Mr Stock suggested that Mr Graham be appointed to decide upon the line. .Mr .Nolan said defendant preferred that a neighbor of his should riot decide the matter. He would nrefer Mr T. Holden. . . Mr Stock intimated that he would confer with Mr Nolan on the subject. The case was then adjourned until to-morrow morning.
