THE GAMING ACT.
AN APPEAL UPHELD. WELLINGTON, July 18. Dolling, a. tobacconist, of Petcne, was convicted under the Gaming Act of using the premises in his occupation as a gaminghouse, and he appealed. Mr Justice Salmond has upheld the appeal, on the ground that there was no instance of bets with any other person than the constable, who sought defendant out and made a bet with him on two occasions. The judge held that the prosecution could not, by proving one or two bets with a single individual, call upon the defendant to rebut a mere suspicion that those bets might, in truth, have been episodes in the conduct, of an established betting business conducted upon the premises in violation of the Act.
