CLAIM FOR COMPENSATION.
WELLINGTON, October 15. The Court of Appeal gave judgment today in the case of Bodell versus William Gable and Co, (Ltd.), in which the question at issue was whether a right to compensation under the Workers’ Compensation Act passed to the executor of the - administrator of an estate of a widow of a deceased worker, there being no other dependents. The widow had commenced an action against the Shaw, Savill, and Albion Company under the Deaths by Accident Compensation Act, but she died before the action came to hearing. Her administrator then claimed compensation under the Workers’ Compensation Act against the defendant company. The court held that it was clear that the right to compensation passed to her administrator as claimed, and this right was not affected by the fact that the widow had commenced another action, and that the present claim was not barred by her selecting another remedy. The Court of Appeal adjourned till November 19.
