ACTION FOR DAMAGES
CLAIM AGAINST* FREEZING COMPANY. WANGANUI, June 6. In the Supreme Court to-day, before the Chief Justice and a_ special jury, a civil action was concluded in which the Wanganui Harbour Board claimed from the Now Zealand Refrigerating Company an amount of £654 for alleged damage to the south mole on the occasion of the wreck of tho defendant company's schooner Eunice. The plaintiffs alleged negligence on the part of the defendant company's servants, and stated that the amount claimed was the actual cost of repair work to the mole that had to be effected. The defendants admitted their vessel collided with the mole; but held that the accident was duo to the elements on the occasion, and that tho master of tho vessel taken every procaution possible in entcrinsr the port. A largo amount, of expert nautical evidence was called by both sides. The jury returned a verdiet in favour of tho defendant company, with costs.
