AN IMPORTANT JUDGMENT.
Mr District Judge Eawson recently delivered a judgment of importance to farmers in the case of Hoskin v. Bayley. In this case defendant undertook Tor reward to thrash out corn, by a steam threshing machine, from plaintiff's stacks. The steam engine was entirely under the control and management of defendant's servants, but plaintiff was to supply the fuel. The engine had not a spark catcher or any such contrivance to arrest sparks. It was proved that a spark from the steam engine, whilst it was working, set fire to and consumed the plaintiff's stacks, The main defence, however, was that plaintiff was guilty of contributory negligence in supplying resiny pine for the furnace, a wood peculiarly liable to emit sparks. His Honor gave judgment for plaintiff for £136 2s 6d, the amount claimed, with costs £11 15s 6d. Notice' of appeal was given.
