THE LODGERS' FRANCHISE ACT,
1875. An Act to qualify Persona living in Lodgings to vote at the Election of Members of the House of Reprebentatives, and to enable such persons to be registered on the Electoral 8011, -o---, [21st October, 1875.] Be it enacted by the General Assembly o* New Zealand in Parliament assembled, and by the authority of the same, as follows :—: — 1. The Short Title of this Act Bhall be " The* Lodgers' Francise Act, 1875." 2. Besides the qualifications which immediately before the passing of this Act entitled persons to vote in tho election of members of the House of Representatives, every male person shall, in and after the year commencing on the first day of January, one thousand eight hundred and seventy-six, be entitled to be registered as a voter and, when registered, to vote for a member or members to serve in the Houße of Representatives for an electoral district, who is qualified as follows, that is to say — 1. Is of full age and not subject to any legal incapacity ; and 2. As a lodger has occupied in the same electoral distiict separately and as a sole tenant, for twelve months preceding the last day of December in any lyear, the same lodgings, such lodgings being part of one and the same dwelling-house, and of a clear yearly value, if let unfurnished, of ten pounds or upwards ; and 3. Has resided in such lodgings during the twelve months immediately preceding the last day of December in such year, and has claimed to be registered as a voter at the nexfc ensuing registration of voters. 3. Every person claiming to be allowed to vota under under this Act shall make application to the Returning Officer of the district in regard lo which be claims to fee entitled to vote in the mode proscribed in the Schedule hereto; Provided that Buch notice Bhall ,be lodged with the Returning Officer at the times prescribed for the reception of claims to 'vote at such elections, and shall be dealt with in like manner with such claims to vote. 4. The qualifications created by this Act shall be in addition to and not in substitution for any existing qualifications, but so that no person shall be entitled to vote forthesama electoral district for more than one qualification. 5. The provisions contained in the fourth, sixth, eighth, and forty-second sections of Ihe Constitution Act, and all other enactments relating to qualifications of electors and .candidates, and to the registration of persons enti' tied to vote, and to the election of members ol the House of Representatives, Superintendents of Provinces, and members of, Provincial Councils, shall be construed and read *s if tho enactments contained in the second seotion herd* of were contained in the seventh section of tho Constitution Act. and shall apply, as nearly aa circumstances admit, to any person hereby authorised to vote and to the qualification hereby created.
SCHEDULE. Claim op Lodoers. Electoral district of To the Returning Officer of the Bald Electoral District. I hereby claim to be inserted in the List of Voters, in reapect of tho occupation of the under-mentioned lodgings, and the particulars of my qualification are Btated in the columns bolow :—: —
I, the above named , hereby deolare that I have been, during the twelve months Immediately preceding the last day of December in last year, the occupier, as sole tenant, of the above-mentioned lodgings ; and that I have resided therein during tho twelve mouths immediately preceding the said last day of December ; and that Ruch lodgings are of & clear yearly value, if let unfurnished, of tea pounds or upwards. Witness te the signature of the said ; and I certify my belief in the accuracy of the said Claim. • Name of Witness : Residence and calling : This Claim must bear dale tho first day of January, or some day subsequent thereto ; and must be delivered to the Returning Officer after the last day of December, and on or bef re tho thirty-flrat day of March.
