Waste Lands Board.

The regular meeting of the Waste Lands Board was held on Wednesday. Present— The Chief Commissioner, Mr J. P. Maitland (in the chair), Messrs Butterworth, Clark, Green, and Strode. The minutes of the previous meeting were read and confirmed.

DISPUTED BOUNDARY AT WTNDHAM.

Messrs Gillies, Street, and Hislop applied to the Board to fix a date for the hearing of a cass of disputed boundary between Dr Menzies and J. Anderson, of Wyndham. Mr R. Gillies, who appeared on beoalf of Dr Menzies, said he did not think it would be possible for the parties to arrange a date for the hearing of the case, as Mr Anderson seemed to desire to put the matter off from time to time. Mr H. Driver, as agent for Mr Anderson, denied that there was any desire on his part for delay. He said that Mr Gillies was simply end«avouring to make use of the Board to assist a case which was now pending before the District Court. Mr Gillies said ii would simplify matters very much if the Board decided that they had no jurisdiction. The matter would then go before Court. The lease runs out very soon. Mr Driver : There is actually a case in the Court now — to come on on the 20th of next month.

The Chaibman : The Board, by a majority, is of opinion thai, While the case is still pending in the Court, it has no power to interfere in the matter. The Board leaves the parties to settle their boundary in the Court by any evidence they may be able to call on the subject. If they cannot do so, and the isatter comes out of the Court, then the Board will re-con-aider the matter.

The following resolution was minuted : — "The Board is of opinion that the matter being still pending in the District Court, it is not at present the province of the Waste Lands Board to interfere."

The application of Mr Gillies— That the words '•till after the termination of the proceedings in the Court" be added to the resolution — was refused by the Board.

APPLICATIONS TO POHCHASE.

Mr Stewart M'Comb's application to purchase sections 25, 26, and 27, Mock XVIIL, Tuapeka East district, under agricultural . ltase, was approved. Mi. John Tuckey'a application to purchase at LI per acre, section 27, block XX., Tuapeka Sast, was declined, the land having been improved. It was resolved that the land should be sold at the first opportunity at the upset price of L 3 per acre. Mr David M'Kellar requested permission to purchase 440 acres on Bun No. 160, immediately south of, and adjoining pre-emptive right of 640 acres on Run 163— waiving his claim to compensation on condition that the land is submitted to auction at the upset price of 20s per acre. Re'erred to Ranger for report as to value of land.

The District Laud Officer, Naseby, reported on J. E. Glover's application to purchase sections 1L 12, 13, and 14, Dunback district, with letters from John Cox and T. Lind, that the lands be retained for mining. Consideration adjourned in order to obtain report furnished by the Warden in 1874, referred to by him in bos present report.

WAIKOUAITI.

Hanger Valpy reported on Henry Wilson's application for lease of section 67, block L, Waikouaiti district, and recommended that the section be divided into 5-acre lots, and sold at the upset price of 30s per acre. There are 42 acres altogether. It was resolved — " That the land be divided into two portions, and sold at the upset price of L 2 per acre."

DEPEBBED PAYMENT LEASE.

The Warden at Arrow transmitted application by Edward Prior for deferred payment; lease of sections 1 and 2, block 111., Dart district, and recommended that block IIL be thrown open on deferred payments for settlement.—Referred to the District Land Officer as to whether his recommendation extends to the whole block, and as to its general adaptability to the deferred payment system.

The Crown Solicitor's opinion was received on request by C. Colclough, that lease granted to J. Nicholson for block XVI. , Cromwell, be cancelled, and that a fresh lease be issued to E. M'Nnlty for said land. — The Board declined, after calling advice, to entertain Mr Coldough's request.

LAWRENCE.

Mr William Watson requested that the sections in block XXXL, Lawrence, formerly nnder lease to Messrs Herbert aiid il'Kinlsy may be submitted to auction, the c al or lignite on the said land being ot* no great value. The District Officer recommended that the land be sold at the upset price of LlO r- er fee tion. — It was resolved — "That the laud be sold at the upset price of Ll2 10* per section at first convenient opportunity.

TIGEB HILL.

The District Land Officer, Clyde, forwarded certificate of application in favour of John Dondaa for part of section 29, block V., Tiger Hill district, now called section 33, and recommended that if license is granted the expense of sorvay of di riding be borne by the applicant. — The certificate was refused.

BOCK AND PILLAR DISTRICT.

The District Land Officer, Naseby, transmitted requests from the undermentioned persons for leases nnder section 54, Otago Waste Lands Act, 1872, witb recommendation that they be granted :— William Price, section 17, and William Dowling, section 15, block VII., Rock and Pillar district. It wa.s resolved — " That the District Land Officer be requested to state whether all conditions of occupation nave been complied with."

TEVIOT.

Mr J. H. Mervyn requested that a road line be recorded between sections 10 and 17, block I. f Teviot district, for better access to bis dwelling an 4 tfce joining reserve j ako Btate-

ment by District Surveyor thereon. — The Board declined to grant the request. Mr D. H. Mervyn. applied for permission to ■withdraw his application for license under the 161 st clause of the Act for 88 acres opposite sections 17, 1, 2, and 3, and 50 acres opposite section 10, block 1., Teviot district. The District Land Officer reported on Mr Mervyn'* application for license under the 169 th section of the Act to occupy 10 to 15 acres opposite sections 16 and 17, sama block, for tree planting, with objections thereto by the occupant of section 16. Withdrawal permitted ; application for license under 169 bh section of the Act declined.

The District Land Officer, Clyde, forwarded James Woodhouse's application for a lease under section 54 for sections 11, 12, 13, and 14, block 111., Teviot district, and a request from Thomas M'lntosh to purchase sections 15, 17, 18, and 20, block 111., and also from Alexander M'Donald to purchase sections 19, 21, 22, and 24, block 111., Teviot district, with recommendation that they be granted subject to deduction of water races passing through the lands. It was resolved — "That the applications be approved." PKOPO3ED RECREATION RESERVE AT OAMARU.

The Mayor of Oamaru requested license under the 161 st section of the Act for block G, Oamaru town, for recreation purposes. TLe following was minuted : — " The Board, having considered the matter, is of opinion that, looking to the very rapid progress the town of Oamaru has already made, and the consequent probability that the reserve in question will be at no distant period required for the purpose for which the reservation was made, it would be inadvisable to deal with it in any way at present."

MISCELLANEOUS.

The District Land Officer, Naseby, recom meuded that leases be granted to William Price and William Dairy. — Referred to District Otficer to ascertain if the conditions have been, complied with. A letter was read from Mr M. C. Orbell, re questing that when Messrs Clark and Green visit and report upon land in the vicinity of Hyde, they be requested to inspect Runs 76 and 77, with the view of obtaining their opinion as to the suitability of the land for settlement.

The Warden at Arrow estimated improve ments effected by Mr G. Lafranchi on his hotel sits at LSOO. — Approved.

Mr Alexander ' Mathesoa applied ior exchange of agricultural for deferred payment lease, section 18, block XVII., Shotover district. It was resolved "That deferred payment lease be granted for 51a. 2r. 35p. that area, together with what is already held by applicant, completing total area allowed by the Act."

The following applications for cancellation of fold mining leases were approved : — James ack and James Gibbs Adams, section 19, block XIX., and T. W. ii' Donald, section 33, block XIX., Shotover district.

The following agricultural lease certificates of application were approved : — Patrick Kerin, sections 76, 77, and 78, block VIII., Shotover ; Pater Sjott, section 19, block V., Table Hill. The Board adjourned.
