A QUIET GAME OF NAP.

Charles Jackson v. B. G. Greenwood. —This case came before Magistrate E. D. Mosley at the Court on Wednesday, and was a claim for the recovery of £2 19s 2d for goods supplied and £1 4s cash lent. The only amount contested was £1 4s.

Mr Porritt appeared for the plaintiff, and Mr Moresby for the defendant.

Evidence was given by the plaintiff that the sum of 24/- was advanced to defendant in his shop.

The defendant said he did not borrow £1 4s, but owed it to Jackson for card-playing-. Plaintiff played cards with him in the shop on several occasions. The Magistrate to defendant: What kind of game was it; was it poker or bridge ? "No, your worship," said defendant, "it was a little game of nap."

"You were playing a long time then if it was Id nap," said the Magistrate.

"Oh !" replied the witness, "it was 3d, 6d, and l/~. We played on Wednesday afternoon with others."

To a further question from the magistrate the defendant said that it was not the only game they had played. Jackson would be telling an untruth if he said he never played cards in his shoo.

The Magistrate : Did you lose this all in one game ?

Yes. I lost more that that, but recognise I owe Jackson 24/- for cards.

The Magistrate then gave judgment for £4 3s 2d, with costs 7/-, and solicitor's fee £1 6s, and remarked that it was a pleasure sometimes to ,give judgment in equity of good conscience.

In the counter claim, brought by Greenwood for services rendered to Jackson, Greenwood was given judgment for £1 12s 6d and costs 6s, less witnesses' expenses 18s. This case occupied a good deal of time, and at the conclusion the Magistrate said that he was not too satisfied with the evidence on either side.
