UNLICENSED VEHICLES.

Albert Benner, of Waihi, was charged on the information of the Borough inspector, that he plied a vehicle in the borough of Paeroa for hire on March 16 last without a license. Evidence was given, by the Borough inspector, Joseph Pennell, and the constable. The defendant and a witness denied the charge and stated that he only drove his load through the town to-the race course and then came into the town again to get oil for his lamp.

After hearing the case the magistrate said that he was not satisfied that the informant's case was complete, and gave the defendant the benefit of the doubt and dismissed the case without costs.

Deverell and Crimmins,-carriers of Waihi, were charged that on March 16 they plied a motor-bus for hire between Waihi and the race course, which is a place situated within the Paeroa Borough, without the motorbus having been duly licensed.

The Borough inspector said that the charge was laid under paragraph 2 of part 8 of the By-laws referring to licensed carriages, and was brought as a test case.

The Magistrate : Is the Borough Council not represented by counsel ?

Mr Brunskill: No, your worship. We leave the matter for you to interpret.

The Magistrate: Very well

'Mr Porritt said that before the witness gave evidence he wished to raise a point of law in that the information did riot disclose any breach.

Again the Magistrate said that as a point of law had been raised the Borough Council should be represented by counsel. ,
