“ Hilarious Football Visit ”

" This event took place after an hilarious football visit,” commented Mr J. D. Willis, S.M., at a sitting of the Oamaru Magistrate’s Court on Tuesday when uncling John Gray Kennedy guilty of behaving in a disorderly manner on July 3 m a public place. A fine of £2 (costs 10s) was imposed. Detective Sergeant J. W Hill conducted the prosecution and Kennedy was represented by Mr J. e. rarj rdl Iri respect to a second charge of assaulting Walter Leslie Hope on July 3 and behaving in a disorderly manner ini a public place, Mr Willis said he found there had been a technical assault, but he would dismiss the case as trivial. Walter Leslie Hope, bus foreman, employed by the New Zealand Railways Road Services, said he received advice that a bus conveying footballers from Georgetown to Ngapara on July 3 had broken down. He arrived witlva relief bus at 8.5 p.m., and noticed that a considerable amount of beer had been consumed. Gordon Alexander Robertson, the driver of the broken-down bus, became abusive, and asked where he had been all the time. The accused Kennedy then entered the .bus which he was driving, took off his coat, used certain language, and invited witness out for a fight. Witness said he made no attempt to leave the bus, and the accused pulled him out of his seat and pushed him around. The accused returned to the bus a second time and again began pushing him about. Kennedy was in a drunken mood. Douglas Henry Anderson, a lorry driver, employed by the Railways Road Services, said some of the footballers appeared to be under the influence of liquor. A passenger, whom he could not identify, became abusive to Hope. This person placed his hand on Hope s . arm on two or three occasions and invited-him outside to fight. This person was in'an angry mood and appeared to be under the influence of liquor. . The accused Kennedy said that before the relief bus arrived the men were not under the influence of liquor and there had been no trouble. When Hope arrived witness entered the bus to get two parcels, and asked Hope where he haa been all night, to which Hope replied that it had nothing to do with him. Tire accused denied laying a hand on Hope, and did not remember taking off his coat. Gordon Alexander Robertson, driver of the broken-down bus, said the accused did not touch Hope, but . a heated argument took place. Cross-examined, he said that in his report to the Railways Department on the incident he had stated that the whole party was rough and annoyed at the late arrival of the relieving bus, and Kennedy was in a wild condition and argumentative. Recalled by Mr Willis, Anderson said he was in the aisle of the bus when the second argument (took place. Kennedy took off his coat, placed his hand on Hope's shoulder and invited him outside to fight. Some bad language was used. “ It has been proved beyond doubt that certain unpleasantness developed," Mr Willis said. In the assault charge he accepted the evidence of Anderson because he was sure that he was speaking the truth. “In my opinion I am certain that some witnesses are not speaking the truth,” Mr Willis said, “ and I say this without hesitation. In the disorderly behaviour charge I again accept the evidence of Anderson that insulting language was used.” Mr Willis said.
