LIABILITY OF PARENT
ALLEGED DAMAGE BY CHILD The liability of a parent to pay. for damage done by a child ; iri a shop while the parent was ■ absent was tested before Mr S. L. Paterson, S.M., -in the Magistrate's Court at Hamilton, when Smith and Smith, Ltd.. claimed £8 4s 9d from Mrs Frances Zohrab, of Fairfield. The plaintiff firm alleged that Mrs Zohrab's small child smashed: a basin and pedestal while the mother was speaking on the telephone in the shop. For the plaintiffs, Mr Johnson contended that the child had run across the shop temporarily out of control and overturned the articles. The mother should have exercised proper supervision of the child. :• ' Mr King, for the defendant, submitted that a parent was not liable for the action of a child unless the parent were guiltv of negligence. There was no negligence oh part of the mother, for there were three shop assistants handy. Counsel alleged that the articles broken were not securely fastened. Decision was reserved.
