BREACH OF PROMISE
CLAIM FOR DAMAGES AWARD 0F ; £BO TO PLAINTIFF • Peh United Press ; Association ) AUCKLAND,' Aug. 9. - A claim for .damages for' alleged breach of promise of marriage came before Mr Justice Fair and a jury of four in the Supreme Court today. The action was brought by Joyce M<"y Simmons, a spinster, aged 22. against Andrew Keith Donald, a milkman, aged 25. The plaintiff alleged that the defendant and she agreed on July 4, 1937. to marry. In anticipation''of this she accumulated a trousseau and household goods of the value of £2OO It was alleged that from the time of their engagement t the present the defendant unknc i to the plaintiff, had been associated with another gir] and had made arrangements to marry her. On March 15 last the defendant rescinded the agreement to marry and refused tc be bound by it. The plaintiff therefore asked for £250 general damages and £75 srjecial damages for depreciation of the trousseau. The defendant denied that there had been a promise of marriage and said if there was they had mutually agreed to cancel the agreement. The jury found for the plaintiff and awarded her £BO general damages.
