SUBSTANTIAL DAMAGES CLAIMED (United Press Association) (By Electric Telegraph— Copyright) SYDNEY.‘June 21. (Received June 21, at 10.10 p.m.) Frank Edgar Russell, owner-trainer of Mala, began an action in the Supreme Court to-day against the Commissioner of Road Transport and Tramways to recover £3OOO damages owing to injuries to Mala. The horse was struck by a tram on the morning of the A.J.C. Derby on October 3. Mr J. Cassidy, who appeared for Russell, claimed that Mala injured a fetlock and legs, as a result of which his chances of winning the A.J.C. Derby, subsequently Sydney and Melbourne classic events, and also the Great Northern Derby in New Zealand were seriously prejudiced. The mishap, Mr Cassidy contended, was primarily due to the excessive speed of the tram. The case is unfinished.
