DAMAGES AWARDED
SEQUEL TO MOTOR COLLISION
SAWMILLER'S LIABILITY (Per United Press Association) AUCKLAND, May 27. The hearing of a claim for £2OOO damages under the Deaths by Accident Compensations Act was concluded to-day in the Supreme Court before Mr Justice Callan and a jury. The action was brought by Arthur Burrows, of Matakohe, a farmer, as administrator of the estate of his wife, Isabella Burrows, and the defendant was Esmond Henry Savage, of Tahuna, a sawmiller.
The action rose" out of a collision between a truck and a motor car at the corner of the East Tamaki road and the Great South road at Papatoetoe on April 27, 1936, and Mrs Burrows died two days later. The car in which she was a passenger was driven by Oscar Clausen, her husband's brother-in-law. and the truck was owned by the defendant and driven by his employee, Rangi Weke. The plaintiff alleged that the accident was due to the negligent driving of Weke.—The defence denied any negligence. The jury returned with a verdict for plaintiff for £750 and funeral expenses of £22. The damages were apportioned by the jury as follows:—£400 for plaintiff, £IOO for his elder daughter, and £250 for a younger daughter.
