LOSS OF AN EYE
VICTIM AWARDED DAMAGES (Per United Press Association) WELLINGTON, November 2. Judgment for £250 general and £l4 special damages was given by a jury in the Supreme Court, in the case in which Lancelot Herbert Lindsay Margolioutli, garage proprietor, claimed £l4 special damages and £BSO general damages from Richard Edward Barrett, mechanic, for the loss of an eye, which was ruptured after the plaintiff had been struck by the defendant. The plaintiff alleged that he was the victim of an unprovoked assault, but the defendant claimed that his actions were those of self-defence to repel a threatened attack by the plaintiff. Mr Justice Blair said the plaintiff started the row by using abusive language, but if the jury felt that this language caused the defendant to lose bis temper so that be used physical violence, the verdict must be for plaintiff.
