In the Supreme Court to-day Henry Horace Smith, who had pleaded not guilty in the Lower Court, admitted stealing coods valued at £l6 12s 10d from Furnesse shop at Miramar, and was remanded till Friday for sentence. James Hopkins, who also had pleaded not guilty in the Lower Court, admitted charges of assault and robbery while armed. This was a case in which Hopkins was alleged to have assaulted and robbed Johanna Byrne and Joseph Byrne at their home in Tinakori road while armed with an automatic pistol. To the Chief Justice (Sir Michael Myers) counsel said he proposed to lead certain evidence about the man s good character, and also wished to put before his Honour something dealing with his war record. He was not putting forward a plea that prisoner was mentally weak. Prisoners were remanded until Friday for sentence. After a retirement of 3 hours 26 minutes the jury returned a verdict of not guilty in the case in which James Colquhoun Kay was charged with negligently driving a car in Esk Valley on November 16 last, thereby causing the death of Thomas Watson Waite.
