PARTIAL LOSS OF SIGHT
STRUCK BY STARTING BARRIEk UNSUCCESSFUL COMPENSATION CLAIM. t (Per United Press Association.) HOKITIKA, June 9. At a special sitting of the Supreme Court to-day presided over by Mr Justice Blair, a claim was made by James Edwin Searle, of Mananui, for the recovery of £1029 damages and compensation for the partial loss of the sight of the right eye, caused by being struck by the tape from the starting barrier at the Westland races in December, 1931. After a hearing which lasted all day his Honor held that negligence by the defandant, the Westland Racing Club, had not been proved. Even if negligence had been proved there was an onus on the plaintiff, who, with others at the starting post, was warned hy the starter of danger and fold to keep clear of the starting apparatus. Judgment was given for the defendant club, with costs. i
