PERMANENT MAINTENANCE.
WIFE’S APPLICATION GRANTED. ORDER MADE AGAINST JOCKEY. (Special xo Daxlx Times.) AUCKLAND, December I. The well-known Auckland Jockey, Benjamin Kinsman Deeley, was the respondent in an application for permanent alimony before Mr Justice Smith in the Supreme. Court to-day. The petitioner was Dons Madge Elizabeth Deeley (Mr Sullivan). Mr Northcroft appeared for tiie respondent. Deeley was cross-examined by Mr Sullivan about the money he had in the bank. This, he said, amounted to about £2OOO, but he might also have “ a few pounds ” in ms current account. A week ago he filed an affidavit that the amount was £2400. Last year his bank account stood at £3500, but he had since made investments “I a company with a capital of £ISOO, of which he held £1499. That company had absorbed about £IBOO of his income in the past 12 months. Until eight or nine months ago Deeley said he was paying his wife £5 a week for the support of herself and two children, aged eight and nine years. Cross-examined about / an offence of being drunk in charge of a motor car Deeley said he had pleaded domestic trouble.
“It seems to be a vicious circle," remarked Mr Sullivan.
In connection with his business venture, Deeley said he had taken two shops. The rental of one expired that day and he had abandoned it. The tenure o‘f the other would continue for two years and a-half.
Mr Northcroft said his client’s capita! was rapidly disappearing, and an attempt was being made to curtail the loss. To his Honor the respondent said he started on a falling market. The goods were not in demand, and he lost capital. Hie Honor made an ’order for the respondent to pay his wife £4 15s a week permanent maintenance.
