Alexander Ferguson (Moegiel), claim £1 2s, for goods supplied, with costs (8a) , JUDGMENT SUMMONS. , Paterson and Barr Ltd., proceeded against W. P. Foley on a'judgment summons, the hearing of which had been adjourned, After hearing the evidence of judgment debtor in respect to his wife’s earnings and income, the magistrate said he had not been candid with the court. He would make an order for'the amount, fl2 fls 10d,. with costs (20s) to be paid forthwith, in default 12 days’ imprisonment, the warrant to be suspended provided the debtor pays Ms a week off the amount. PLAINTIFF NON-SUITED. The magistrate gave his reserved judgment in the case in which J. A. Brown, ■jun., proceeded against J. K. R, Begg for the sum of £97 11s 6d, being the cost of repairs to a car and depreciation on the 'vehicle as a result of , a collision alleged to have been caused by defendants negligence. -Mr W. D. Taylor appeared for the plaintiff and Mr J. S. Sinclair for the defendant. The magistrate said that from the evidence before him, he was unable to arrive at any. definite conclusion, but the . independent evidence in the case appeared to him to bear out the account of the defendant in respect to the occurrence; He would, therefore non-suit the plaintiff with costs, but owing to the uncertainty of counsel tor the defendant on the subject of the witnesses’ expenses required, he would defer the entering of judgment until Tuesday. RECOVERY OP LOAN. Annie Campbell, for whom Mr H E. Barrowclongh appeared, proceeded against the Public Trustee, Wellington, as administrator of the estate of Elizabeth Mitchell Lindsay, on a claim for £SO, the amount of money lent by the plaintiff to Elizabeth Mitchell Lindsay. Mr W. D. Taylor appeared for the defendant. After hearing: the evidence of proof advanced by plaintiff, the magistrate said there was no question whatever that the money had been paid, while there was no evidence as to repayment. ■ Judgmeht would be' given for the plaintiff for ,the full claim, £SO, with costs (£6 ss). CLAIM FOR DAMAGES. Harry Smith Tily, for whom Mr W. D. Taylor appeared, claimed from the Tilbury Forwarding Company, Ltd. (Mr Buchler) the sum of £8 10s, the cost of repairs to a motor car damaged in. a collision near Victoria wharf. It was alleged tjjat the collision was the result of negligent. and unskilful driving on the part of a servant of the defendant company. After hearing the evidence, the magistrate gave judgment for the plainl- - for the full amount claimed, together with costs (£1 9e), solicitor’s fee (£1 Gs), and witnesses’a expenses (£2 2s).
