Reserved judgment was given in the Magistrate’s Court that the premises of a travelling ' photographer were not a‘ shop and the ordinary hours need not be observed. The Labour Department proceeded against a photographer for failure to observe the half-holiday. The' Department will appeal. ELTHAM, May 21. The threatened action against the Eltham Argus by Pete Sarron,- the boxer, claiming £3OO damages for alleged libel in connection with that newspaper’s report of the Sarrou-Donovan fight at New Plymouth will not reach the court. The defendants paid £2n into court, and Sarron’s solicitors, Messrs O’Donnell and Cleary, of Wellington, have accepted the amount paid in as full satisfaction. WELLINGTON, May 21. John Bernard M'Donald, alias Frederick M'Alister, aged 29, a slaughterman, and James Olsen, aged 36, a labourer, who were found on the premises of the Grand Opera House on the night of May 10, were to-day committed for trial on charges of attempting to break and enter the counting house of J. C. Williamson, New Zealand, Ltd., with intent to commit a crime and with being rogues and vagabonds in t(\at they were found by night without lawful excuse in the Grand Opera House building. The story was that the night watchman found a broken file in a lock and summoned the police, a search revealing the two men hiding behind seats in the stalls. ASHBURTON, May 21. Mr Justice Kennedy delivered his reserved judgment on the nonsuit point that.the verdict was against the weight of evidence in the case in which Margaret M'Beath was awarded £1250 as damages for the' loss of her husband as the result of a motor collision, against Roy Wallace (the driver) and Fleming and Co. The finding is in favour of plaintiff, and a motion for a now trial has been filed.
