CLAIM FOR DAMAGES.
SEQUEL TO MOTOR COLLISION. (Per United Press Association.) , WANGANUI, May 21. After a retirement of three hours tonight at the end of the third hearing of the case in which Herbert Frederick Benson claimed £SOO general damages and £134 special damages from Kwong. Chong as a result of a motor collision, the jury awarded £IOO general damages and £134 special damages. In February last Mr Justice Reed and a jury awarded the full claim of £634, but counsel moved for a new trial on the grounds that the verdict was against the weight of evidence. To-night the jury found that defendant’s driver was driving at an excessive speed, but not on the wrong side of the road. Plaintiff was not negligent in cutting the corner of the street, but was negligent in attempting to cross another street of the intersection. The jury found that if both were negligent, neither up to the last moment could have avoided the accident. Defendant’s driver could have avoided the accident by the exercise of ordinary care.
