INTERPRETATION OF WARRANTY. CLAIM AGAINST VENDOR PAILS. (Per United Press Association.) PAHIATUA, December 6. An interesting stock case, based on the interpretation of the wording of a warranty given in respect of the sale of some cattle was involved in a claim for £26 10s made by C. T. Kecble, of Palmerston North, against F. Ebbett, of Makomako in the Magistrate’s Court today. The magistrate (Mr J. Miller) said that the wording of the contract—" all guaranteed sound in their quarters”— scorned plain. They did not mean sound at some future date, hut at the time of the sale. This clearly placed the onus on the plaintiff to show that the cows were unsound at the day of the sale. In this case that had not been clearly established. The warranty could .not be interpreted in any other way than it was written. Judgment was entered for the defendant with cusls.
