SELECTING WINNERS.
THE SUN COMPETITION. GAMING ACT INFRINGED. (Per United Press Association.) AUCKLAND, March 9. In the Police Court to-day the Sun Newspaper was fined £5 on each of three charges brought under the Gaming Act as the result of racing competitions conducted last year. . The charges were of establishing a lottery, receiving money in consideration to pay money oh the contingency of a horse race, and last, with receiving money as a consideration for a promise to pay £IOOO as the result of the New Zealand Cup and the New Zealand Trotting Cup. In his reserved judgment Mr W- K. M'Kean, S.M., said he was not prepared to deny that the possession of some knowledge' of the form of horses might not be an advantage to competitors. However, the accurate placing of horses at a time when it was not known whether some of the horses would be scratched was a matter in which the element of chance predominated. It had been decided that a game in which there was a mixture of skill and chance was unlawful. “The defendants, therefore,” he said, “ would be convicted and fined £5 on each of three charges.”
