Press Association—By Telegraph—Copyright^ LONDON, JcJytS- ‘ Mr Justice Branson, of the King'S Beach, is taking evidence m on nnportartb test action, upon which other claims depend, relating to brownheart in apples. Messrs Bradley and Sons, Covent Gatzw ( den, are claiming £4314 from the Federal Steam Navigation Company, owners of the iM/YT-i.bTTrriFw-rtanfl, owing to the development of brownheart in apples shipped on the Northumberland from Hobart in April, 192 L ' . The main issue of the case is the plain*tiS’s allegation that the brown heart-was due to bad ventilation in the Northumberland's bold. The defence is that the brownheart was due to inherent defects in the apples when' shipped. The defendants altemar Lively plead that the apple cases were insufficiently ventilated, and they also'rely on the exceptions set out in the bills ot lading, relating to perils of the sea, giving toe owners immunity from responsibility in toe event of reasonable means i having been taken to protect' against ai ship’s defects and unseaworthiness. —A» and N.Z.
