An important reserved judgment from a Sint heard at the May sitting of (he court was delivered by the Warden, Mr Dixon, at the Court, at Cromwell to-day. The privilege attacked was a water right from Bendigo Gully which for many years was held in connection with the Bendigo mine, and in later years was acquired by tho Otago Central Consolidated Gold Mines. Thomas M’.Felin. a farmer in the locality, brought a suit for forfeiture on the ground of non-usage. In a lengthy decision the warden found ilia! the defendant company was not in a sound financial position. It had not made a serious attempt to use the water for some time, and showed no prospect of doing so in the immediate future. He further pointed out that tho water was required for power for working the mine, but be held that if further development work took place the Hydro-electric Power Board would meet the position. A decree of forfeiture was issued, with cosA and fees amounting to £l3 against tho *lefendant company.
