Tuesday, September 13. (Before Mr H. Y. Widdowson, S.M.)

Judgment was given for plaintiffs in tlie following undefended caeca:—D.l.C. v. F. Bunting (Auckland), coats 10s; Briscoe and Co. v. Samuel Alfred Holley, £l7 18s Id, for goods supplied (costs £2 15s). J. Hanna v. John Purcell (Lawyer’s Head). —Claim £5 2s, for rent of a house in Carroll street.—Mr E. J. Anderson appeared for plaintiff.—There was a counter-claim for £ll 10s for work done. —Mr Anderson stated that defendant ended! his tenancy on May 30. The tenancy was terminated owing to defendant not having paid his rent and on account of his unclean habits about the place. —Evidence having been given by plaintiff and his son, Purcell stated that he had left the house on May 20, andl given up the key the same night. His rent book was kopo at plaintiff’s place for weeks at a timp. —William Mason stated that he shifted Purcell on May 20., and the furniture was stored, but where witness could not say.—Mr Anderson asked witness if he did not know that Purcell and his wife were now living the simple life on the top of Lawyer’s Head, to - which witness replied that he did not know.—Mrs Parcel’ stated that she and defendant left the house on May 20, and that she was sure they did because it was on that day they bought a tent to live in.— Defendant not being able to pay the hearing fee (15s) in connection with the counterclaim, this was struck out.—Mr Anderson remarked that the whole thing was a farce, as tho fowl-house (referred to in the counterclaim) was a collection of old timber an« boxes, and not worth more than 30s at tho outside.—Judgment was given for plaintiff for £1 8s 6d, with costs (365), he being also allowed 18s ooets on the counter-claim.
