CONDEMNED FRUIT.
CLAIM BY CONSIGNOR FAILS. (Pek United Press-Association.) AUCKLAND, March 6. At the Magistrate's Court T. E, Shiel, of Dunedin, was sued by W. Grove, of Auckland, for £55 lis 6d in respect to oranges and Bananas shipped at Rarotonga with a certificate from the inspector stating that to the beat of his knowledge they were free froin fruit fly.. When the fruit reached Danedin 90 eases of oranges were condemned on the ground that they were affccted with the fruit fly. They were condemned and destroyed without reoohing the defendant. Mr Kettle, S.M., Mid it was cleaj that the fruit was not shipped in prime order and oondition, although it appeared to be so. The defendant was entitled not to accept delivery at Dunedin. Judgment would be for the defendant in respect to 90 cases; sottlomonfc of the actual amounf to be arranged by counsel, Defendant was allowed costs. ■ Leave was granted to appeal.
