COURT OF APPEAL.

(Per United Press Association.) WELLINGTON, October 26. The Appeal Court was to. have given judgment to-day in Genet v. Genet, but Mr Justice Williams said that tho members of the court had been unable to agree, and it was therefore impossible to give judgment that day. The court had reason to suppose that, the same question was at present before the English Court of Appeal. The English statutes were exactly' in the same terms as the New Zealand statutes on this matter, and" tho Privy Council had laid it down, that in such a case the colonial courts ought to follow the decision in the English Court of Appeal. That would'be .esuecially the caso in matrimonial causes, where the status of British subjects would be atfected by the decision. In these circumstances it was the duty of the court to hold ils hand until the decision ot the' English courts was pronounced. Judgment would there-' fore stand over until tlie next' sitting of the court.
