Summonses. — Duuedin Distributing Company (Ltd.) v. David OBood.— Claim £2 15s 6d, on a judgment summons.— Defendant oould not appear on accmuit of influenza,, but was represented by his wife, who gavo evidence of inability to pay.—The Magistrate retusod to make an order. B, 11. Scott and Co. (Mr W. Ij. Moore) ,v. Henry Taylor Bain.—Claim £1 16a lOd, on ft judgment summons.—Defendant gavo evidence as to fe earnings and position, after wliich the order was. dismissed.

Claim for Commission—James Christie and Co. v. Mary Soanlan (Milton).—Mr A. S. Adams for plaintiffs, and Mr G. 11. Thompson for defehdant.--The statement of claim set out that defendant Agreed to a commission of -2J per cent; if plaintiffs sold her farm at Akatoro; that plaintiffs found a purchaser on Juno 4, the price (£4339 10s) being paid to dofepdaut; and that of the commission (£lO3 10s) only £69 had been paid, leaving a balance of £39 10s, which dofendant refused to pay.—The dcleiicc was that 110 agreement was made to pay, 2j per cent., and that 2k per cent, had been represented as the Chamber of Commerce rate.— Tl'e..
